인권위, 실효성 빠진 '공염불 권고'

[인권위/CTN]가요진 기자= 김학자 국가인권위원회 침해구제제2위원회 위원장은 "개별적인 송환 가능성과 보호 필요성에 대한 검토 없이 이루어진 일률적 연장은 '필요 최소한의 보호'라는 개정 법률 취지에 부합하기 어렵다"라며 "외국인 보호제도가 장기·자의적 보호를 방지하는 실질적 통제장치로 기능하도록 운영 실태를 지속 점검하겠다"라고 말했다. 국가인권위원회는 개정 외국인 보호제도의 현장 실태를 점검하고 보호외국인의 절차적 권리를 보장하도록 법무부장관에게 관련 정책 개선을 권고했다고 8월 27일 밝혔다.
인권위는 2025년 6월 1일부터 보호기간 상한제도와 외국인보호위원회 연장승인제가 도입됨에 따라 서울출입국·외국인청, 화성외국인보호소, 청주외국인보호소를 대상으로 방문조사를 실시했다. 조사 결과 보호심사청구서 비치가 미흡하고 보호기간 연장심사 안내가 부족한 것으로 나타났다. 특히 2025년 8월 30일 기준 보호기간 연장승인 신청 360건 중 355건(98.6%)이 법정 상한인 3개월로 일률 신청되는 관행이 확인됐다.
이에 인권위는 법무부장관에게 심사청구서 및 보호일시해제 신청서 비치와 접수증 교부, 구술심리신청권 명시 및 통역 인프라 마련을 권고했다. 아울러 보호 개시 단계부터 상한제도를 안내하고 연장 신청 시 개별 사유별 필요 기간을 검토하며, 연장 결정 시 최소 10일 이상의 의견제출 기간을 보장할 것을 촉구했다. 또한 불복할 권리를 보호외국인이 이해할 수 있는 언어로 고지할 것을 함께 권고했다.
인권위는 개정된 외국인 보호제도가 실질적인 통제장치로 정착할 수 있도록 현장점검을 지속해 나갈 계획이라고 밝혔다.
