Hak-ja Kim, Chair of the Standing Committee of the National Human Rights Commission of Korea (NHRCK), stated, "Applying uniform extensions without individual reviews on deportation feasibility fails to align with the amended law's intent of 'minimum necessary detention.'" Chair Kim added, "We will continuously monitor field operations to ensure the revised foreigner detention system serves as an effective control mechanism against arbitrary detention." The NHRCK announced on August 27 that it recommended the Minister of Justice improve policy practices to guarantee procedural rights for detained foreigners.
Following the implementation of the maximum detention period system on June 1, 2025, the NHRCK conducted on-site inspections at the Seoul Immigration Office, Hwaseong Foreigner Detention Center, and Cheongju Foreigner Detention Center. The investigation revealed insufficient availability of petition forms and inadequate guidance on review procedures. Notably, as of August 30, 2025, 355 out of 360 extension applications (98.6%) were requested uniformly for the maximum legal limit of three months.
Consequently, the NHRCK recommended that the Minister of Justice make application forms accessible, provide submission receipts, state the right to oral hearings, and establish translation infrastructure. The commission also urged providing at least 10 days for submitting opinions during extension reviews and informing detainees of appeal rights in languages they understand.
The NHRCK stated that it plans to continue monitoring field operations to ensure the revised framework prevents arbitrary long-term detention.
