그러나 인권위는 장애인차별금지법 제24조의2를 근거로, 단순한 비용 발생이나 민간 시설이라는 사유만으로 정당한 편의 제공을 거부한 것은 장애인 차별행위에 해당한다고 판단했다.
이에 따라 A 리조트에는 실질적 편의 제공 및 관광구간 내 데크 설치 검토를, ○○군에는 법적 기준 준수 여부 재검토와 직원 대상 적극행정 교육을 각각 권고했다.
