[행안부/CTN]가요진 기자= 윤호중 행정안전부 장관이 법안 의결 소식을 전하며 "이번 보행안전법 개정으로 어린이 등 보행취약계층의 안전을 높이는 데 크게 기여할 것으로 기대한다"라며 "지방정부와 긴밀히 협력하여 개정 법률이 현장에 안착할 수 있도록 최선을 다하겠다"라고 밝혔다. 행정안전부(장관 윤호중)는 보호구역과 학교 주변 공사장에 보행안전통로 설치를 의무화하는 '보행안전 및 편의증진에 관한 법률' 일부개정안이 8월 4일 국무회의에서 의결됐다고 발표했다.
행안부에 따르면 이재관 더불어민주당 의원이 대표 발의해 국회를 통과한 이번 개정안은 어린이·노인·장애인 보호구역과 교육환경보호구역 내 공사장에 적용된다.
기존 법률은 공사 중 보행자길을 직접 점용하는 경우에만 안전시설을 설치하도록 규정해, 점용하지 않는 공사장 주변은 낙하물이나 붕괴 위험에 무방비로 노출된다는 지적을 받아왔다. 이에 개정안은 보행자길 점용 여부와 상관없이 모든 공사장 사업자에게 보행안전통로와 안전시설 설치 의무를 부과했다. 행안부는 현장 준비 기간을 고려해 법안 공포 6개월 후부터 본격 시행에 들어간다고 덧붙였다.
이처럼 그동안 안전 관리 사각지대에 놓여있던 도심 및 학교 주변 공사장의 위험 요인을 인식하고 보행취약계층의 통학로 안전을 위해 입법적 규제를 강화한 것은 보행권 확보 차원에서 의미 있는 행보로 평가된다.
다만 위험 공사장이 현장에 방치되어 온 상황에서 법안 개정 자체를 치적으로 홍보하고, 6개월이라는 긴 시행 유예기간을 두어 당장 현장의 위험을 방치하는 것은 생색내기용 행정이라는 지적을 피하기 어렵다. 법안 조항 몇 개를 바꾸는 통과의례에 그치지 않고, 법 시행 전이라도 지자체 현장 점검반을 즉시 투입해 가림막과 낙하물 방지망을 즉각 보강하도록 지도하는 실질적인 행정력이 뒤따라야 할 것으로 보인다.
