[¿µ¹®¹ø¿ª ±â»ç-AIȰ¿ë]

Yeon-woo Jeong, Vice Commissioner of the Korea Intellectual Property Office (KIPO), stated on July 21, "Attempting to acquire patents unfairly causes serious consequences that undermine trust in IP administration. We will filter out loophole patents and create an environment where honest inventors and companies can protect their true technology." KIPO announced a policy overhaul to strictly examine and impose registration invalidations as well as criminal penalties on abnormal patent applications that violate good-faith principles.

Under the proposed amendments, if false experimental data is found in a patent specification, post-registration corrections will be banned and the entire patent will be invalidated. Criminal penalties for 'Fraudulent Acts' will be strengthened from up to 3 years imprisonment or 30 million won in fines to up to 5 years imprisonment or 50 million won in fines. Additionally, a 'consultative collaborative examination system' involving examiners from multiple technical fields will be implemented to block improper applications that combine unrelated technologies.

While these measures are praised for uprooting unfair practices that compromise the credibility of the patent system, concerns remain that shifting the burden of proof to applicants could impose excessive administrative burdens on small businesses and independent inventors.

To ensure long-term success, strict punishment against malicious fraud must be carefully balanced with clear evidentiary guidelines and enhanced examination expertise to prevent innocent applicants from being unfairly disadvantaged.
