"꼼수 특허 잡는다" 지식재산처 '신의성실' 법 개정

[지재처/CTN]가요진 기자= 정연우 지식재산처 차장이 21일 "부정하게 특허를 획득하려는 행위는 지식재산 행정의 신뢰를 무너뜨리는 심각한 결과를 초래한다"라며 "꼼수 특허를 걸러내고, 정직한 발명자와 기업의 '진짜 기술'이 정당하게 보호받을 수 있는 환경을 만들겠다"라고 밝혔다. 지식재산처는 허위 실험 자료 작성이나 타인 기술 도용 등 신의성실 원칙을 위반한 비정상적 특허 출원에 대해 엄격한 심사와 함께 등록 무효, 형사처벌까지 추진하는 제도 정비 방안을 발표했다.
개정안에 따르면 앞으로 명세서에 허위 자료가 기재된 사실이 적발되면 해당 특허의 정정이 불허되고 전체가 무효 처리된다. 현행 3년 이하 징역 또는 3천만 원 이하 벌금인 '거짓행위의 죄' 형량도 5년 이하 징역 또는 5천만 원 이하 벌금으로 강화된다. 아울러 핵심 기술과 무관한 타 기술을 무의미하게 결합한 편법 출원을 막기 위해 기술 분야별 심사관이 함께 심사하는 '자문형 협업 심사'와 직권 무효심판 제도가 함께 가동된다.
이번 조치는 특허 제도의 신뢰성을 어지럽히는 불공정 행위를 뿌리 뽑고 정직한 기술 개발자를 보호한다는 측면에서 긍정적인 변화로 평가받는다.
다만 신의성실 위반 의심 시 출원인에게 직접 정당성을 입증하도록 책임을 묻는 절차가 자칫 영세 기업이나 개인 발명가에게 과도한 행정적 부담으로 작용할 수 있다는 우려도 나온다. 악의적인 기망행위는 엄단하되, 심사 과정에서 정당한 출원인이 억울하게 피해를 보지 않도록 명확한 입증 가이드라인 마련과 심사 전문성 제고라는 보완책이 한층 정교하게 갖춰져야 할 것으로 보인다.
