The Supreme Court's First Division ruled that even if a teacher's language or behavior during classroom guidance is partially inappropriate or flawed, it cannot be hastily concluded as "emotional child abuse" unless it severely impairs or poses a clear threat to the child's mental health and normal development. The Court established a strict standard, clarifying that emotional abuse must reach a level "equivalent to inflicting physical damage, abandonment, or neglect."
For years, the educational community has suffered from mechanical and indiscriminate judgments where teachers' routine educational activities were classified as emotional abuse based on minor flaws, ignoring the overall context and educational intent. Although the actual rate of prosecution or conviction remains extremely low, reported teachers have faced severe psychological and professional trauma—including the threat of suspension and the burden of lawsuits—while enduring lengthy investigations and trials lasting from months to years to prove their innocence.
"This ruling is a significant turning point that stops the trend of lower courts strictly applying criminal punishment by isolating a teacher¡¯s individual remarks," an educational sector source stated. "It prevents legitimate discipline from being distorted into a crime."
The educational sector also pointed out that the 'Superintendent's Opinion System,' which was introduced to verify the legitimacy of educational activities during police investigations, is not being effectively implemented. They urged investigative agencies to fully consider the unique nature of school environments and the scope of teachers' discretion in light of the Supreme Court's decision.
Kang Ju-ho, a prominent educational sector official, emphasized, "The Supreme Court's ruling does not grant special privileges to teachers; rather, it is a clear message from the judiciary to balance the original intent of child abuse laws with the unique nature of educational activities." He warned, "In a classroom where teachers stop giving guidance out of fear of being sued, neither education, student growth, nor the right to learn can be protected."
Kang urgently called on the government and the National Assembly to implement fundamental legislative improvements to block malicious lawsuits.
